CIPL EU Simplification Workshop Project – Workshop I Report: Recommendations on the Digital Omnibus on AI Regulation

This report is based on our first technical workshop for CIPL’s Simplification Project. The workshop was focused on the proposed AI Act Omnibus and explored targeted amendments that could simplify implementation while preserving the AI Act’s objectives: enabling trustworthy, human-centric AI and innovation, while protecting health, safety, fundamental rights, and the environment.

The report highlights practical recommendations aimed at improving legal certainty, reducing fragmentation, and strengthening operational workability, including:

  • Preserving technological neutrality (avoiding new technology-specific categories such as “Agentic AI” unless clearly necessary);
  • Calibrating Article 5 prohibitions to avoid overbreadth while addressing clearly defined harmful practices;
  • Ensuring fixed, predictable implementation timelines, including a minimum 12-month transition period following harmonized standards;
  • Making registration requirements more proportionate and focused on meaningful accountability documentation;
  • Enabling practical and lawful access to data for effective bias detection and mitigation, including retention for ongoing monitoring where strictly necessary;
  • Strengthening and harmonizing regulatory sandboxes and other innovation tools, with proportionate DPA involvement;
  • Reinforcing institutional coordination and mutual recognition across Member States to prevent market fragmentation and support consistent supervision.
